Terms of service

1. Acceptance of terms

By downloading, installing or using CoveGuard (the "App") you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the App.

2. Licence

We grant you a limited, non-exclusive, non-transferable and revocable licence to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell or lease any part of our services or software.

3. User accounts

You are responsible for keeping your login credentials confidential and for all activity under your account. Report any unauthorised use to us immediately at [email protected].

4. Prohibited use

You may not use the App to: • Break any applicable law or regulation. • Transmit false or misleading distress signals. • Interfere with how other people use the App. • Attempt to reverse-engineer or obtain the source code.

5. Intellectual property

All content, trade marks and software in the App remain the exclusive property of CoveGuard or its licensors. Hazard reports contributed by the community are provided to CoveGuard under the Creative Commons CC-BY 4.0 licence.

6. Limitation of liability

To the maximum extent permitted by law, CoveGuard is not liable for any indirect, incidental, special or consequential damages arising from the use of, or the inability to use, the App. Total aggregate liability will not exceed the amount paid for the Service in the 12 months preceding the claim.

7. Governing law

These Terms are governed by the law of the Czech Republic. Any disputes will be settled by the courts in Prague.

8. Changes to the terms

We reserve the right to change these Terms at any time. We will announce material changes 14 days in advance with an in-app notice.

Maritime safety disclaimer

An aid to navigation only

CoveGuard is an aid to navigation intended to supplement, not replace, conventional navigation methods. All route suggestions, weather data, tidal predictions and depth figures are for information only and must be verified against official, up-to-date charts and Notices to Mariners.

No warranty of accuracy

GPS accuracy, weather data, AIS targets and community reports may be inaccurate, incomplete or out of date. CoveGuard gives no warranty, express or implied, as to the accuracy, completeness or fitness for purpose of any information provided.

Proper lookout

Always keep a proper lookout by sight and hearing, as required by COLREGS Rule 5. Using CoveGuard does not relieve the officer of the watch of the duty to keep an effective lookout at all times.

Skipper responsibility

The master (skipper) of any vessel bears sole and full responsibility for the safe navigation and operation of the vessel, for the safety of everyone on board and for compliance with applicable maritime law. CoveGuard accepts no liability for any marine casualty, grounding, collision, injury or loss of life resulting from reliance on the App.

Emergencies

In any emergency use the official distress procedures (VHF DSC channel 70, EPIRB, flares). Do not rely on the in-app SOS feature alone. The CoveGuard SOS assistant is a supplementary tool only.
